Lex Humanitas reveals where form hides power and replaces meaning.

Principle: A Separated Structure of Proof (Event → Position → Discrepancy → Legal Qualification)

a universal model for constructing proof

Purpose

This principle establishes a method of constructing proof in which:

  • facts are not replaced with interpretation;
  • the parties’ positions are not confused with reality;
  • a conclusion is not declared, but emerges as a result of comparison.

This eliminates a key error found in most texts: merging an event, a position, and an assessment into one indistinguishable mass.

Basic Logic

Proof is not an assertion.

Proof is a construction in which a contradiction becomes observable.

Layer 1: Recording Events (Ontology of Fact)

This is the level of pure registration of reality.

At this level, there is no:

  • rightness;
  • guilt;
  • assessment;
  • interpretation.

There is only what happened.

Permitted

  • date (with day and month specified);
  • time;
  • actions;
  • documents;
  • sequence;
  • verbatim wording.

Prohibited

  • any evaluative constructions (“unfounded,” “contradicts,” “unlawful,” “erroneous”);
  • any causal connections (“therefore,” “consequently,” “in this connection”).

Layer Formula

Event → Event → Event → Event

Without explanations.

Layer 2: Recording Positions (Ontology of Assertions)

Here a second reality appears, not events, but how the parties describe them.

Important: a position is not a fact, even if it coincides with a fact.

What Is Recorded

  • who is speaking;
  • what exactly they say;
  • where it is recorded;
  • when it was recorded (date required).

Layer Formula

Party X asserts A (source, date)

Without evaluating credibility.

Layer 3: Comparison (The Node of Distinction)

This is the first layer in which distinction arises.

No new knowledge is created here; structures already recorded are compared.

Permitted Constructions

  • “does not correspond”;
  • “contradicts”;
  • “is not supported”;
  • “does not follow from the recorded circumstances.”

Layer Formula

Recorded: B
Asserted: A

→ There is a discrepancy between A and B: ___

The key point: the discrepancy must be shown, not merely declared.

Only after:

  • there are facts;
  • there is a position;
  • there is a discrepancy,

can the law be brought in.

Otherwise, a substitution takes place: the law begins to “evaluate thin air.”

What Appears Here

  • a legal norm;
  • a statutory article;
  • a legal construction of responsibility.

Layer Formula

Where a discrepancy exists (A ≠ B), the rule ___ applies, providing for ___

Core of the Principle

A fact does not contain a conclusion about itself.
A conclusion arises only through comparison of different layers.

Critical Error

Mixing the layers:

  • fact + evaluation → in one sentence;
  • event + “consequently” → in one paragraph;
  • position + refutation → without first recording the position itself.

This destroys the proof, because the reader ceases to see where reality ends and interpretation begins.

Additional Structural Check

Sign of a Violation

If the factual section contains words such as:

  • “consequently”;
  • “thus”;
  • “this confirms”,

then Layer 1 has been destroyed.

Sign of a Correct Structure

It should be possible to:

  1. Remove all of Layers 3 and 4 and still have a clean, coherent sequence of events.
  2. Read only Layer 2 and see the parties’ positions without commentary.
  3. Add Layer 3 and have the discrepancy become evident without pressure.

Why This Works (Mechanism, Not Rhetoric)

A court (or any subject carrying out an analysis) goes through three stages:

  1. Sees reality.
  2. Sees the versions of events.
  3. Discovers the discrepancy.

If the conclusion is given immediately, the second stage disappears, and the reader feels resistance: instead of “seeing” the discrepancy, they are “given” a ready-made interpretation.

Short Formula

Reality → Version → Discrepancy → Law

Mini-Template (Universal)

  1. [Date, time] the following occurred: ___
  2. Supported by: ___
  3. Party X asserts in [date, source]: ___
  4. Comparison: recorded ___, asserted ___ → discrepancy: ___
  5. Applicable rule: ___
  6. Legal consequence: ___

Final Formulation

Proof is not an explanation of why one’s position is right,
but the construction of a structure in which the discrepancy becomes inevitably observable.
